Terms of Service

1. Acceptance of Terms

SUPERCARTAS is a platform operated by Black Engine Technologies SAS de CV, a company incorporated under the laws of the United Mexican States, taxpayer ID (RFC) BET180206MU5, with registered address at Ciudad Apodaca, Nuevo León (Mexico).

By accessing, registering, or using SUPERCARTAS ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use our services. We reserve the right to modify these Terms at any time; changes will be effective upon publication on this page.

2. Description of Service

SUPERCARTAS is an online marketplace that allows users to buy and sell trading card game (TCG) products and related items. In user-to-user transactions, SUPERCARTAS acts solely as a technology platform connecting buyers and sellers: it is not a party to the transaction, does not take possession of items, and does not act as a financial intermediary. Separately, SUPERCARTAS may sell its own inventory; on those listings it appears as the seller and acts as the vendor with every obligation that entails (clause 7.2).

Services include:

  • Fixed-price and auction-format item listings
  • Bidding and offer system
  • Coordination of meetups at safe locations (SafeSpot) and messaging between the parties
  • Review and reputation system
  • Search tools and product catalog
  • Sale of SUPERCARTAS's own inventory, identified as such on the listing

3. Eligibility and User Accounts

To use SUPERCARTAS you must:

  • Be at least 18 years old or have authorization from a legal guardian
  • Provide truthful information and keep it up to date
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activity under your account. SUPERCARTAS reserves the right to suspend or cancel accounts that violate these Terms.

4. Listings

By listing items on SUPERCARTAS, you represent and warrant that:

  • You are the legitimate owner of the item or are authorized to sell it
  • The description, photos, and condition of the item are accurate and truthful
  • The item does not violate our Prohibited Items policies
  • You will fulfill shipping commitments once the sale is completed

SUPERCARTAS reserves the right to remove listings that violate these policies without prior notice.

5. Auctions and Bids

  • Bids are binding. By placing a bid, you commit to completing the purchase if you win.
  • Sellers are obligated to honor completed auctions and ship the item to the winner.
  • Bids cannot be canceled once placed, except in exceptional circumstances determined by SUPERCARTAS.
  • If an auction has a reserve price that is not met, the auction will end without a sale.
  • SUPERCARTAS reserves the right to cancel auctions that violate the Terms or show suspicious activity (shill bidding, price manipulation).

6. Fixed-Price Purchases

  • Buyers may add items to their cart and create orders grouped by seller.
  • By creating an order, the buyer commits to paying the seller directly as described in clause 7.
  • Sellers commit to handing over or shipping items once payment has been received.
  • Each seller may set a minimum order amount.

7. Payments

Two kinds of sale coexist on SUPERCARTAS, and the payment regime differs. Every listing states who the seller is.

7.1 User-to-user sales (most of the catalog)

SUPERCARTAS does not process, hold, escrow or intermediate these payments. Payment is settled directly between buyer and seller — by SPEI bank transfer to the account the seller provides, or in cash at handover in a safe location (SafeSpot). The Platform never collects or receives the transaction amount, does not issue tax receipts for that sale, and does not store bank or card data.

  • Buyers must settle within the timeframe agreed with the seller. The Platform does not guarantee that payment will occur.
  • In case of non-payment, the transaction may be canceled and the buyer may receive a reputation penalty.
  • Returns and refunds are agreed directly between the parties, in accordance with applicable Mexican Consumer Protection Law. SUPERCARTAS does not refund amounts it never received.
  • Verify the counterparty's identity and the card's condition before transferring or handing over. We recommend using SafeSpot and paying at the moment of the meetup.

7.2 Sales made by SUPERCARTAS

When the seller is SUPERCARTAS (Black Engine Technologies SAS de CV) selling its own inventory, the transaction is an ordinary purchase from us and we do process the payment:

  • We accept credit and debit cards (Stripe) and cash at retail (Conekta: OXXO, 7-Eleven, Farmacias del Ahorro, Soriana, Walmart, Bodega Aurrera, Chedraui and other participating chains). Card data is handled by the PCI-DSS certified provider; SUPERCARTAS does not store it.
  • We are your vendor for the purposes of the Mexican Federal Consumer Protection Law: warranty, returns and refunds are on us, per the published policy and the law.
  • We issue a Mexican tax receipt (CFDI) on request, using the billing details you provide.
  • Refunds go back through the original payment method, unless the law or the payment provider requires otherwise.

These payment methods are not available for user-to-user sales. SUPERCARTAS does not run third-party transactions through its processing accounts: we are neither an aggregator nor a financial intermediary for community sellers.

Any fees or subscriptions SUPERCARTAS charges for use of the Platform — where they exist — are separate from the user-to-user sale and are detailed on the Fees page.

8. Shipping and Delivery

  • The seller is responsible for packing and shipping items safely.
  • Shipping costs are determined by the seller and communicated to the buyer before completing the transaction.
  • Using tracked shipping services is recommended for valuable items.
  • The buyer must confirm receipt of the item through the platform.
  • If the buyer does not confirm receipt within a reasonable period, the order may be automatically completed.

9. Disputes Between Users

In case of conflict between buyer and seller:

  • We recommend first attempting to resolve it directly through order comments.
  • If no agreement is reached, either party may report the issue to SUPERCARTAS.
  • SUPERCARTAS may mediate the dispute, but is not obligated to act as an arbitrator nor guarantees a favorable resolution for either party.
  • Currently, SUPERCARTAS does not offer a formal buyer protection program with refund guarantees. We are working on implementing these protections. Please check our Buyer Protection page for updates.

10. User Conduct

The following is prohibited:

  • Harassing, threatening, or discriminating against other users
  • Posting false, misleading, or defamatory content
  • Manipulating auctions or prices (shill bidding)
  • Creating multiple accounts to evade restrictions or suspensions
  • Attempting to contact other users outside the platform to evade fees
  • Using the platform for illegal activities
  • Reverse engineering, scraping, or unauthorized access to SUPERCARTAS systems

11. Prohibited Items

Counterfeit cards, stolen items, and other prohibited items are not allowed. Please refer to our Prohibited Items page for the complete list.

12. Fees

Platform usage fees are detailed on our Fees page. SUPERCARTAS reserves the right to modify fees with prior notice to users.

13. Intellectual Property

  • All SUPERCARTAS content (logos, design, code, text) is the property of SUPERCARTAS or its licensors and is protected by intellectual property laws.
  • Trading card game trademarks, names, and logos (Pokémon, Magic: The Gathering, Yu-Gi-Oh!, One Piece, etc.) belong to their respective owners.
  • By posting content (photos, descriptions), you grant SUPERCARTAS a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the platform.

14. Limitation of Liability

SUPERCARTAS is provided "as is" and "as available". To the extent permitted by law:

  • We do not guarantee the quality, safety, legality, or authenticity of items posted by users.
  • We are not responsible for the actions, omissions, or breaches of buyers or sellers.
  • We are not liable for indirect, incidental, special, or consequential damages arising from use of the platform.
  • We do not guarantee uninterrupted availability of the service.

15. Indemnification

You agree to indemnify and hold SUPERCARTAS harmless from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the platform, violation of these Terms, or infringement of third-party rights.

16. Termination

SUPERCARTAS reserves the right to suspend or cancel your account at any time, with or without notice, for violation of these Terms. You may cancel your account at any time by contacting [email protected]. Account cancellation does not release you from pending obligations (in-progress orders, open disputes).

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. For the resolution of any dispute, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
